Conditional uses allow certain types of development to be considered on a case-by-case basis.
What is a Conditional Use?
A conditional use is a land use that may be allowed in a zone, but requires approval from Council to ensure it is appropriate for the specific location.
Why is approval required?
Some land uses may have impacts depending on where they are located.
Conditional uses are reviewed to ensure they:
- Are compatible with surrounding land uses
- Do not create negative impacts (e.g., traffic, noise, servicing)
- Meet municipal policies and regulations
- Are appropriate for the specific site
When is a Conditional Use required?
A conditional use is required when a proposed use is listed as “conditional” in the Zoning By-law.
Application Process
1. Pre-Application Meeting (Recommended)
Applicants are encouraged to meet with municipal staff to discuss the proposal and requirements.
2. Submit Application
Submit a completed application form along with:
- Property information
- Description of the proposed use
- Supporting documents (e.g., site plan, building plans, etc.), if required
3. Application Review
Municipal staff review the application and prepare a report for Council.
4. Public Notice
Nearby property owners are notified by mail.
5. Public Hearing
Council holds a public hearing where:
- The proposal is presented
- The applicant may speak
- The public can provide comments
This is the main opportunity for public input.
6. Council Decision
After the public hearing, Council will:
- Approve the application (with or without conditions); or
- Reject the application
Council may apply conditions to address concerns or ensure compatibility.
Application Fees
- $400 (standard applications)
- Livestock applications: $4.00 per Animal Unit
- Additional fees may apply if a variance is also required
Who does this apply to?
Conditional use approval may be required for:
- Property owners proposing a new or expanded use
- Agricultural, commercial, or specialized developments
